Condiciones generales de contratación

1. Identificación del vendedor

2. Objeto y aceptación

Estas condiciones regulan la compraventa de obra original y de láminas a través de la tienda del sitio web y se aplican a todo pedido realizado en ella. Al marcar la casilla de aceptación antes de completar el pedido, el comprador declara haberlas leído y las acepta íntegramente.

Cuando el comprador tenga la condición de consumidor conforme al artículo 3 del texto refundido de la Ley General para la Defensa de los Consumidores y Usuarios, aprobado por el Real Decreto Legislativo 1/2007, de 16 de noviembre, le serán además de aplicación las normas imperativas de protección que dicha norma le reconoce.

El contrato puede celebrarse en castellano o en inglés. El vendedor archiva el documento electrónico en que se formaliza y lo pone a disposición del comprador que lo solicite.

3. Las obras

El sitio web ofrece dos tipos de productos, sujetos a un régimen parcialmente distinto:

Obras originales. Piezas únicas realizadas en técnica mixta, acrílico y óleo sobre lienzo. La ficha de cada obra indica su título, técnica, dimensiones y año de realización. Cada obra original se entrega acompañada de un certificado de autenticidad firmado por el autor.

Láminas. Reproducciones giclée de obra del autor, impresas bajo demanda por un proveedor externo mediante tecnología fine art de doce tintas, con acabado mate liso y sin reflejos, sobre papel de 200 g/m² y 0,26 mm de espesor con certificación FSC. No son piezas únicas, se editan en tirada abierta y no se entregan firmadas ni numeradas. La ficha de cada lámina indica su formato y la obra reproducida.

Las imágenes son reproducciones fotográficas y pueden presentar variaciones de color, brillo, textura y escala respecto del original, según el dispositivo desde el que se visualicen. Las irregularidades de superficie, el relieve del empaste y las variaciones propias de la ejecución manual forman parte de la obra y no constituyen defecto. En las láminas, las diferencias de tono respecto de la pantalla desde la que se visualizan y la textura propia del papel elegido tampoco constituyen defecto.

4. Precio, impuestos y gastos

Los precios figuran en euros e incluyen los impuestos aplicables y el seguro de transporte. No incluyen los gastos de envío y embalaje, que se calculan en función del destino y de las dimensiones de la obra y se muestran de forma desglosada antes de que el comprador confirme el pedido.

En los envíos con destino fuera del territorio aduanero de la Unión Europea, los aranceles, tributos y gastos de despacho exigibles en el país de destino corren a cargo del comprador y no están incluidos en el importe abonado. El vendedor cumplimentará la documentación de exportación describiendo la obra como pintura original ejecutada enteramente a mano.

5. Procedimiento de compra

Conforme a los artículos 27 y 28 de la Ley 34/2002, de 11 de julio, de servicios de la sociedad de la información y de comercio electrónico, el procedimiento es el siguiente:

1. El comprador selecciona la obra y la añade a la cesta.
2. Introduce sus datos de contacto, facturación y entrega.
3. Revisa el resumen del pedido, con el precio, los gastos de envío y el importe total. Antes de confirmar puede modificar la cesta, corregir los datos introducidos o cancelar el proceso.
4. Acepta estas condiciones y confirma el pedido pulsando el botón de pago, cuya activación comporta obligación de pago.
5. Realiza el pago.

El vendedor acusa recibo del pedido mediante correo electrónico dirigido a la dirección facilitada, dentro de las veinticuatro horas siguientes a su recepción. Ese correo incorpora la confirmación del contrato y el detalle del pedido.

6. Formas de pago

Se admite el pago con tarjeta de crédito o débito a través de la pasarela Stripe y el pago mediante PayPal. El pago se tramita íntegramente en el entorno seguro del proveedor correspondiente, sin que el vendedor tenga acceso a los datos de la tarjeta o del instrumento de pago utilizado. Los medios de pago disponibles en cada momento se muestran antes de confirmar el pedido.

7. Disponibilidad

Cada obra original es una pieza única y su disponibilidad es, por definición, unitaria. Si por error se recibieran dos pedidos sobre la misma obra o esta hubiera sido vendida por otra vía, el vendedor lo comunicará al comprador afectado sin demora y reembolsará íntegramente el importe abonado, incluidos los gastos de envío, sin coste alguno para él.

Las láminas se producen bajo demanda y no están sujetas a límite de existencias. El vendedor podrá retirar del catálogo cualquier lámina o modificar los formatos ofrecidos, sin que ello afecte a los pedidos ya confirmados.

8. Envío, entrega y riesgo

Los envíos se realizan a España —incluidas Baleares, Canarias, Ceuta y Melilla—, a los demás Estados miembros de la Unión Europea, al Reino Unido y a los Estados Unidos de América. Para cualquier otro destino, el envío se atiende previa consulta y presupuesto a través del canal de contacto. Los envíos con destino a Canarias, Ceuta y Melilla quedan fuera del territorio de aplicación del impuesto sobre el valor añadido de la Unión y pueden generar trámites y tributos de importación a cargo del comprador, conforme a lo previsto en el apartado 4.

Cada obra se embala a medida en caja rígida. El plazo de preparación y expedición es de hasta diez días hábiles desde la confirmación del pago. A él se añade el de transporte, estimado en dos a cinco días hábiles para España peninsular y Baleares, cinco a diez días hábiles para Canarias, Ceuta y Melilla, para el resto de la Unión Europea y para el Reino Unido, y diez a quince días hábiles para los Estados Unidos, al que puede sumarse el tiempo de despacho aduanero, ajeno al control del vendedor.

Por sus dimensiones, las obras de gran formato no admiten todos los destinos: las que superan noventa centímetros en su lado mayor se expiden a España y Canarias, y las que superan ciento veinte centímetros requieren transporte especializado dentro de España. El proceso de compra muestra, antes de confirmar el pedido, los destinos disponibles para cada obra y el importe del envío; para los demás destinos se presupuesta a través del canal de contacto.

Las láminas se producen y expiden a través de un proveedor externo de impresión bajo demanda, que las fabrica en la instalación más próxima al domicilio del comprador. El plazo estimado es de hasta dos días hábiles de tramitación del pedido, más cinco a diez días hábiles de producción y transporte. Cuando la producción se realiza en el mismo territorio aduanero que el destino, el envío no genera trámites ni derechos de importación; en caso contrario, resulta aplicable lo previsto en el apartado 4.

Las partes acuerdan expresamente estos plazos, distintos del previsto con carácter supletorio en el artículo 109 del texto refundido citado, por exigirlo la naturaleza de la obra, su embalaje a medida y la distancia del destino. El vendedor comunicará al comprador la fecha de expedición y el número de seguimiento, e informará sin demora de cualquier circunstancia que impida cumplir el plazo indicado.

Las obras se envían embaladas y aseguradas. Conforme al artículo 66 ter del mismo texto, el riesgo de pérdida o deterioro se transmite al comprador cuando este, o un tercero indicado por él distinto del transportista, adquiera la posesión material de la obra. Se recomienda examinar el embalaje en el momento de la recepción y hacer constar cualquier daño aparente en el albarán del transportista.

Si el comprador rechaza la entrega sin causa justificada, o si el envío es devuelto al vendedor por no haber atendido aquel los trámites o tributos de importación exigibles en el país de destino, el vendedor podrá deducir del reembolso los gastos de transporte de retorno efectivamente soportados y debidamente acreditados. Esta previsión no se aplica cuando el comprador haya ejercido su derecho de desistimiento conforme al apartado 9.

9. Derecho de desistimiento

El comprador que sea consumidor y tenga su residencia habitual en un Estado miembro de la Unión Europea o en el Reino Unido dispone de catorce días naturales para desistir del contrato sin necesidad de justificación y sin penalización. El plazo se cuenta desde el día en que él o un tercero indicado por él adquiera la posesión material de la obra.

En los envíos con destino fuera de la Unión Europea y del Reino Unido no resulta aplicable el derecho de desistimiento. Las devoluciones se atenderán, en su caso, previo acuerdo con el vendedor, corriendo el transporte y el despacho aduanero a cargo del comprador.

Para ejercerlo basta con comunicar la decisión antes de que expire el plazo, mediante una declaración inequívoca dirigida a gualberto.salas@gmail.com o utilizando el formulario que figura al final de este documento, cuyo uso no es obligatorio.

El comprador deberá devolver la obra sin demora indebida y, en todo caso, dentro de los catorce días naturales siguientes a la comunicación de su decisión, debidamente embalada. Los costes directos de devolución corren a su cargo. Responde de la disminución de valor resultante de una manipulación distinta de la necesaria para establecer la naturaleza, las características y el funcionamiento de la obra.

El vendedor reembolsará todo pago recibido, incluidos los gastos de entrega ordinarios, sin demora indebida y, en todo caso, antes de que transcurran catorce días naturales desde que fue informado de la decisión de desistir, utilizando el mismo medio de pago empleado en la compra. Si el comprador eligió una modalidad de entrega distinta de la ordinaria menos costosa, no se reembolsará el sobrecoste. El reembolso podrá retenerse hasta haber recibido la obra o hasta que el comprador acredite haberla devuelto.

Excepción aplicable a los encargos. Conforme al artículo 103.c) del texto refundido citado, no cabe desistimiento en el suministro de obra confeccionada conforme a las especificaciones del comprador o claramente personalizada. El vendedor informará expresamente de esta circunstancia antes de que el comprador quede vinculado por el contrato.

Láminas. El derecho de desistimiento se aplica igualmente a las láminas. La elección por el comprador entre los formatos y papeles ofrecidos por el vendedor no convierte la lámina en un bien confeccionado conforme a sus especificaciones ni claramente personalizado a efectos del citado artículo 103.c). Las devoluciones se remitirán en todo caso al domicilio del vendedor indicado en el apartado 1, y nunca a la dirección del proveedor de impresión.

10. Garantía legal de conformidad

El vendedor responde de las faltas de conformidad que se manifiesten en el plazo de tres años desde la entrega, conforme al artículo 120 del texto refundido citado. Durante los dos primeros años se presume que la falta de conformidad ya existía en el momento de la entrega, salvo que la presunción sea incompatible con la naturaleza del bien. La acción para reclamar prescribe a los cinco años desde que se manifieste la falta de conformidad.

La garantía no cubre la evolución natural de los materiales pictóricos ni los daños derivados de una conservación inadecuada, de la exposición prolongada a la luz solar directa, a la humedad o a fuentes de calor, ni de manipulaciones, limpiezas o intervenciones realizadas por el comprador o por terceros. En las láminas tampoco cubre la decoloración derivada de la exposición prolongada a la luz solar directa ni los daños causados por la humedad o por un montaje o enmarcado inadecuados.

11. Propiedad intelectual

La adquisición de una obra transmite su propiedad material, pero no los derechos de explotación sobre ella, que se reservan íntegramente al autor conforme al artículo 56 del texto refundido de la Ley de Propiedad Intelectual. El comprador no queda facultado para reproducir, distribuir, comunicar públicamente ni transformar la obra sin autorización escrita del autor, sin perjuicio del derecho de exposición pública que le reconoce el apartado segundo de dicho artículo.

La adquisición de una lámina no transmite derecho de explotación alguno sobre la obra reproducida. El derecho de exposición pública que reconoce el apartado segundo del artículo 56 corresponde únicamente al propietario del original, por lo que no ampara al adquirente de una lámina.

En caso de reventa posterior en la que intervenga un profesional del mercado del arte, resultará aplicable el derecho de participación del autor regulado en la Ley 3/2008, de 23 de diciembre. Este derecho no alcanza a las láminas de tirada abierta, que no tienen la consideración de originales conforme al artículo 1 de dicha ley.

12. Reclamaciones y resolución de conflictos

El comprador puede dirigir cualquier reclamación a gualberto.salas@gmail.com, que será atendida en el plazo más breve posible. Ello es sin perjuicio de su derecho a acudir a los organismos de consumo competentes o a la vía judicial.

13. Ley aplicable y jurisdicción

Estas condiciones se rigen por el Derecho español. Cuando el comprador sea consumidor, esta previsión se entiende sin perjuicio de la aplicación de las normas imperativas de protección que le reconozca la ley de su país de residencia habitual, ni de su derecho a demandar y ser demandado ante los tribunales de dicho Estado, conforme al artículo 6 del Reglamento (CE) n.º 593/2008 (Roma I) y a los artículos 17 a 19 del Reglamento (UE) n.º 1215/2012 (Bruselas I bis).

Anexo. Formulario de desistimiento

Solo debe cumplimentarse y enviarse si se desea desistir del contrato. Su uso no es obligatorio.

2. Scope and acceptance

These terms govern the sale of original works and prints through the website's store and apply to every order placed there. By ticking the acceptance box before completing an order, the buyer confirms having read them and accepts them in full.

Where the buyer is a consumer within the meaning of Article 3 of the consolidated text of the Spanish General Act for the Protection of Consumers and Users, approved by Royal Legislative Decree 1/2007 of 16 November, the mandatory protective rules of that Act also apply.

The contract may be concluded in Spanish or in English. The seller files the electronic document recording it and makes it available to any buyer who so requests.

3. The works

The website offers two types of product, governed in part by different rules:

Original works. One-of-a-kind pieces in mixed media, acrylic and oil on canvas. Each listing states the work's title, technique, dimensions and year. Every original work is supplied with a certificate of authenticity signed by the artist.

Prints. Giclée reproductions of the artist's work, printed on demand by an external supplier using twelve-colour fine art printing technology, with a smooth matte, glare-free finish, on FSC-certified paper of 200 gsm and 0.26 mm thickness. They are not unique pieces, they are issued in open editions, and they are not supplied signed or numbered. Each listing states the size and the work reproduced.

Images are photographic reproductions and may differ from the original in colour, brightness, texture and scale depending on the device used. Surface irregularities, the relief of the impasto and the variations inherent in hand execution form part of the work and do not constitute a defect. In the case of prints, differences in tone from the screen on which they are viewed, and the texture of the paper chosen, likewise do not constitute a defect.

4. Price, taxes and costs

Prices are stated in euros and include applicable taxes and transit insurance. They do not include shipping and packaging costs, which are calculated according to the destination and the dimensions of the work and are itemised before the buyer confirms the order.

For deliveries outside the customs territory of the European Union, any customs duties, taxes and clearance charges payable in the country of destination are borne by the buyer and are not included in the amount paid. The seller will complete the export documentation describing the work as an original painting executed entirely by hand.

5. Ordering procedure

In accordance with Articles 27 and 28 of Spanish Act 34/2002 of 11 July on information society services and electronic commerce, the procedure is as follows:

1. The buyer selects a work and adds it to the basket.
2. The buyer enters contact, billing and delivery details.
3. The buyer reviews the order summary, showing the price, shipping costs and total amount. Before confirming, the basket may be amended, the details corrected or the process cancelled.
4. The buyer accepts these terms and confirms the order by activating the payment button, which entails an obligation to pay.
5. The buyer makes payment.

The seller acknowledges receipt of the order by e-mail to the address provided, within twenty-four hours of receiving it. That e-mail contains confirmation of the contract and the order details.

6. Payment

Payment may be made by credit or debit card through the Stripe payment gateway, or through PayPal. Payment is processed entirely within the relevant provider's secure environment; the seller has no access to card or other payment instrument details. The means of payment available at any given time are displayed before the order is confirmed.

7. Availability

Each original work is a unique piece and its availability is, by definition, a single unit. Should two orders for the same work be received in error, or should the work have been sold through another channel, the seller will inform the buyer concerned without delay and refund the full amount paid, including shipping costs, at no cost to the buyer.

Prints are produced on demand and are not subject to any limit of stock. The seller may withdraw any print from the catalogue or alter the sizes offered, without affecting orders already confirmed.

8. Shipping, delivery and risk

Shipping is available to Spain —including the Balearic Islands, the Canary Islands, Ceuta and Melilla—, to the other Member States of the European Union, to the United Kingdom and to the United States of America. For any other destination, shipping is handled on request, with a prior quotation through the contact channel. Shipments to the Canary Islands, Ceuta and Melilla fall outside the territory in which European Union value added tax applies and may give rise to import formalities and duties payable by the buyer, as set out in section 4.

Each work is packed to measure in a rigid box. Preparation and dispatch take up to ten working days from confirmation of payment. To this must be added transit time, estimated at two to five working days for mainland Spain and the Balearic Islands, five to ten working days for the Canary Islands, Ceuta and Melilla, for the rest of the European Union and for the United Kingdom, and ten to fifteen working days for the United States, to which customs clearance time, beyond the seller's control, may be added.

Because of their dimensions, large-format works cannot be sent to every destination: works whose longest side exceeds ninety centimetres are shipped to Spain and the Canary Islands, and works exceeding one hundred and twenty centimetres require specialised transport within Spain. Before the order is confirmed, the purchase process shows the destinations available for each work and the shipping cost; for other destinations a quotation is provided through the contact channel.

Prints are produced and dispatched by an external print-on-demand supplier, which manufactures them at the facility closest to the buyer's address. The estimated time is up to two working days to process the order, plus five to ten working days for production and transit. Where production takes place within the same customs territory as the destination, the shipment gives rise to no import formalities or duties; otherwise, the provisions of section 4 apply.

The parties expressly agree these periods, which differ from the default period laid down in Article 109 of the consolidated text referred to above, as required by the nature of the work, its bespoke packing and the distance to the destination. The seller will notify the buyer of the dispatch date and the tracking number, and will report without delay any circumstance preventing compliance with the stated period.

Works are shipped packed and insured. Under Article 66 ter of the same text, the risk of loss or damage passes to the buyer when the buyer, or a third party indicated by the buyer other than the carrier, acquires material possession of the work. Buyers are advised to inspect the packaging on receipt and to record any visible damage on the carrier's delivery note.

If the buyer refuses delivery without good reason, or if the shipment is returned to the seller because the buyer has not dealt with the import formalities or duties payable in the country of destination, the seller may deduct from the refund the return transport costs actually incurred and duly evidenced. This does not apply where the buyer has exercised the right of withdrawal under section 9.

9. Right of withdrawal

A buyer who is a consumer and has habitual residence in a Member State of the European Union or in the United Kingdom has fourteen calendar days to withdraw from the contract without giving any reason and without penalty. The period runs from the day on which the buyer, or a third party indicated by the buyer, acquires material possession of the work.

For shipments to destinations outside the European Union and the United Kingdom, the right of withdrawal does not apply. Returns will, where appropriate, be handled by prior agreement with the seller, with transport and customs clearance at the buyer's expense.

To exercise it, it is enough to communicate the decision before the period expires, by an unequivocal statement addressed to gualberto.salas@gmail.com or using the form set out at the end of this document, the use of which is not compulsory.

The buyer must return the work without undue delay and in any event within fourteen calendar days of communicating the decision, properly packed. The direct cost of return is borne by the buyer, who is liable for any diminished value resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the work.

The seller will reimburse all payments received, including the ordinary delivery costs, without undue delay and in any event within fourteen calendar days of being informed of the decision to withdraw, using the same means of payment used for the purchase. If the buyer chose a type of delivery other than the least expensive ordinary one, the additional cost will not be reimbursed. Reimbursement may be withheld until the work has been received or until the buyer provides evidence of having returned it.

Exception applicable to commissions. Under Article 103(c) of the consolidated text referred to above, there is no right of withdrawal for the supply of works made to the buyer's specifications or clearly personalised. The seller will expressly inform the buyer of this before the buyer becomes bound by the contract.

Prints. The right of withdrawal applies to prints as well. The buyer's choice among the formats and papers offered by the seller does not make the print a good made to the buyer's specifications or clearly personalised for the purposes of Article 103(c). Returns must in all cases be sent to the seller's address given in section 1, and never to the address of the print supplier.

10. Legal guarantee of conformity

The seller is liable for any lack of conformity which becomes apparent within three years of delivery, in accordance with Article 120 of the consolidated text referred to above. During the first two years, the lack of conformity is presumed to have existed at the time of delivery, unless that presumption is incompatible with the nature of the goods. Claims are time-barred five years after the lack of conformity becomes apparent.

The guarantee does not cover the natural evolution of pictorial materials, nor damage resulting from inadequate conservation, prolonged exposure to direct sunlight, humidity or heat sources, nor from handling, cleaning or intervention by the buyer or by third parties. In the case of prints, it likewise does not cover fading resulting from prolonged exposure to direct sunlight, nor damage caused by humidity or by inadequate mounting or framing.

11. Intellectual property

Purchasing a work transfers ownership of the physical object but not the exploitation rights in it, which remain entirely with the author under Article 56 of the consolidated text of the Spanish Intellectual Property Act. The buyer is not entitled to reproduce, distribute, communicate to the public or transform the work without the author's written authorisation, without prejudice to the right of public exhibition conferred by the second paragraph of that Article.

The purchase of a print transfers no exploitation right whatsoever in the work reproduced. The right of public exhibition conferred by the second paragraph of Article 56 belongs solely to the owner of the original and therefore does not extend to the purchaser of a print.

On any subsequent resale involving an art market professional, the author's resale right under Spanish Act 3/2008 of 23 December will apply. That right does not extend to open-edition prints, which are not regarded as originals under Article 1 of that Act.

12. Complaints and dispute resolution

Buyers may address any complaint to gualberto.salas@gmail.com, which will be dealt with as promptly as possible. This is without prejudice to their right to apply to the competent consumer authorities or to the courts.

13. Applicable law and jurisdiction

These terms are governed by Spanish law. Where the buyer is a consumer, this is without prejudice to the application of the mandatory protective rules of the law of his or her country of habitual residence, and to the right to sue and be sued in the courts of that State, in accordance with Article 6 of Regulation (EC) No 593/2008 (Rome I) and Articles 17 to 19 of Regulation (EU) No 1215/2012 (Brussels I bis).
